Update – What You Need to Know in the Event of a Minor Accident

With the aim of relieving traffic on the road network and preventing traffic congestion caused by minor traffic accidents, as well as reducing risks to road safety, the law has defined “minor accidents” and what drivers must do in such cases; they are now required to move their vehicles from the scene of the collision.

This must be done provided that the criteria for a minor accident are met and that it is reasonable to do so—that is, taking into account the traffic conditions at that moment, time, and day of the collision, as well as the safety of those involved and other road users, drivers are required to move the vehicle to the nearest safe location off the road so as not to obstruct traffic.

What is a “minor accident”?

The removal of vehicles is mandatory and applies to a traffic collision when ALL of the following conditions are met:

  • A traffic collision between vehicles on any road (including open areas, squares, or public spaces).
  • There are no visible physical injuries on any person.
  • The presence or intervention of the police at the scene is not required.
  • The vehicles can be moved without being towed and without causing further damage to either the vehicles themselves or the road surface.
  • Given the prevailing conditions on the road surface and the street, it is reasonable for vehicles to move.

Actions Drivers Should Take before moving their vehicle to the nearest safe spot off the road

  1. Contact Accident Assistance

The insured must contact the company’s Accident Assistance department immediately, and before traveling, in accordance with the terms of the insurance policy, at 77778107.

Accident Assistance: will provide support and information to the driver.

  1. Photography and data collection

Before traveling:

 

(a) Record the following:

  • driver information (full names, phone numbers)
  • vehicle information,
  • insurance information (their policy numbers)
  • Driver's License Numbers
  • passenger information (if available).

(b) Take photographs:

  • the vehicles at the point of collision (before any movement),
  • of license plates,
  • damage (to the vehicles involved and/or to third-party property, if any, e.g., bollards, a wall),
  • an overall view of the scene (the area surrounding the accident—even from a slight distance to show the course of the road, any side streets if a vehicle exited from them, any skid marks, and obstacles obstructing visibility—depending on the specific circumstances and conditions of each accident),
  • road signs and road conditions.

The parties involved share the photos they have taken with one another. Our insured driver sends them:

  1. Accident Care—as will be indicated to them at the appropriate time
  2. Starting on July 15, 2026, our policyholders can also use the MyTrust app on their mobile phones (Android or iPhone) to upload and instantly send photos and other details directly to the company’s systems.
  1. Vehicle Movement

Provided that the requirements of the law are met and the necessary photographs and information have been obtained, regardless of whether or not the drivers involved agree:

  • Vehicles must be moved safely from the scene of the collision to the nearest safe location off the road to avoid obstructing traffic, where they should wait for accident response personnel.

When is the minor accident procedure NOT applied?

The procedure does NOT apply when:

  • there is an injury or a suspected injury,
  • Police or an ambulance are needed,
  • The vehicle cannot move without being towed,
  • there is a risk of further damage or danger to either the vehicles themselves or the road surface,
  • only one vehicle is involved, with no collision with another vehicle,
  • an uninsured vehicle is involved,
  • a government vehicle is involved,
  • Any driver who leaves the scene (in which case the police must be notified immediately).

Important Update

The law stipulates that, when the criteria for a minor accident are met, the drivers involved are required to move their vehicles.

Failure to comply with the obligations set forth in the law—namely, the obligation to move vehicles when the conditions are met, as well as to take the required actions prior to moving them, as well as encouraging or coercing another driver not to comply with the procedure, may result in the consequences provided for by law, which stipulates that such actions constitute an offense and are subject to the prescribed penalties.

CAUTION

When moving vehicles, do not wander around on the road, especially on highways or roads with heavy traffic. It is dangerous. Stay in a safe place.
